The Commissioners' Court of Tom Green County Texas met in Regular Session, May 26, 2020 in the Edd B. & Frances Frink Keyes Building with the following members:

1. County Judge Stephen C. Floyd called the meeting to order and ratified that a Quorum is present at 8:30 am. 

2. The Invocation was given by Commissioner Rick Bacon.
Commissioner Bacon led in the Pledges to the United States and the State of Texas. 


3. Announcement: Anyone intending to address the Commissioners’ Court shall complete and turn in to the County Judge a Witness Testimony form with the exception of Tom Green County Employees who are providing resource information pursuant to an Agenda item.
             
4. Moved to approve the following items on the CONSENT AGENDA as presented: 

A. Acknowledged the minutes from the last meeting(s) of May 19, 2020. 
 
           B.  Moved to approve the Treasurer's Claim Register, through May 15, 2020, in the amount of $308,693.17, Correction for last week's Claims Register in the amount of $1,980,912.86 and the Bills to be paid, through May 15, 2020, in the amount of $1,353,642.91.

6.  Consider Burn Ban.  The Burn Ban if off.
             
7. Recessed the Open Session and Convened a Public Hearing to take public comment and answer questions regarding eligibility and designation of reinvestment zone for property tax abatement at 8: 37 AM.
J
udge Floyd explained the first step in the project is to designate a reinvestment zone.  He also explained the Abatement process for proposed projects.
 There were a number of Wall residents in attendance.  A lengthy discussion followed with many questions regarding the proposed solar project.  The land owners involved in the project were present as well as many of the neighbors in the proposed area.
Those presenting testimony, asking questions or answering questions were:
Michael Looney- Chamber, Richard Gruber- Merit Sustainable Infrastructure, by phone- Diana Rivera- Merit SI Project manager, Will Wiggins, Kim Marshall, Kerri Williams, Miles Glory, Doyle Lovell, Allen Gully, Larry Saha, Russel Dacy,
Commissioner Farmer, Commissioner Bacon, Commissioner Ford and Judge Floyd.
Others were present, but did not speak.
Richard Gruber had a printed presentation that is attached.

8. Adjourned the Public Hearing at 10:08 AM.    Judge Floyd reconvened the regular meeting at 10:15 AM.

9. Consider adopting a resolution designating a Reinvestment zone located in Precinct 2 of Tom Green County at the request of Concho Valley Solar, LLC, for property tax abatement under the Property Redevelopment and Tax Abatement Act, Chapter 312 of the Texas Tax Code.

Judge Floyd explained that the Court has a very limited power to restrict land usage with the exception of Sexually Oriented Business, any type of Man Camps, Subdivision rules for development and if the land is deemed a public nuisance.  Texas is a Property Rights state and protects the land owner.   The County has been working with the Chamber to promote the appropriate Economic Development projects to help lessen the burden of the homeowners.
He also reminded the public of Tom Green County's history which began with property all the way to the Pecos River.  13 other counties were created out of Tom Green since 1884 and along with those creations, the mineral rights went with those Counties.
