The Commissioners' Court of Tom Green County Texas met in Regular Session, September 1st, 2015 in the Edd B. Keyes Building with the following members:

1. County Judge Stephen C. Floyd called the meeting to order and ratified that a Quorum is present
at 8:15 am. 

2. Recess the Open Session at 8:15 am

3. Convene Closed/Executive Session  at 8:15 am – The Commissioners’ Court will meet in Closed/Executive Session in accordance with V.T.C.A. Government Code, Chapter 551, Subchapter D. as follows:

§551.071(1) seeking attorney's advice with respect to: (A) pending or contemplated litigation; or (B) a settlement offer; or matters where the duty of a public body's counsel to his client, pursuant to the Code of Professional Responsibility of the State Bar of Texas, clearly conflicts with this act; (A) and/or (B) including, but not limited to, the following cases: 
   
§551.072 to deliberate with respect to purchase, exchange, lease, or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third party. 
     
§551.073  to deliberate a negotiated contract for a prospective gift or donation to the state or the governmental body if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person. 
 
§551.074(1) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee; or (2) to hear a complaint or charge against an officer or employee, unless employee requests a public hearing.

§551.076  to deliberate the deployment, or specific occasions for implementation, of security personnel or devices. 
 
§551.087 deliberation regarding economic development negotiations.

4. Adjournment of Closed/Executive Session at 8:37 am.

5. Reconvene in Open Session at 8:46 am.

6. The Invocation was given by Commissioner Ralph Hoelscher.
Commissioner Hoelscher led in the Pledges to the United States and the State of Texas. 


7. Announcement: Anyone intending to address the Commissioners’ Court shall complete and turn in to the County Judge a Witness Testimony form with the exception of Tom Green County Employees who are providing resource information pursuant to an Agenda item. 
             
8. Moved to approve the following items on the CONSENT AGENDA as presented: 
A. Acknowledged the minutes from the last meeting(s) of August 25th, 2015. 

B. Consider Treasurer Claims Register and Bills to be Paid Report.
 

 
Moved to approve the Treasurer's Claim Register (2), through August 27th, 2015, normal bills in the amount of $356,706.97 and State Apply Back bills in the amount of $165,184.80.

12.  Consider updates and information from the County’s financial advisor on potential future capital financing plans. (Bob Henderson, RBC Capital Markets)

Mr. Henderson updated the Court on the procedures for doing a "Certificate of Obligation" with a projected 20year payout for the proposed capital improvements addressed in the recent needs assessment report.  No Action. 

Mr. Henderson requested a point of personal privilege to Congratulate Mike Brown on his retirement and thank him for his service.

11.  Consider county-wide burn ban. (Commissioners Court)  Burn Ban Continues.  No Action.
             
13. Consider authorizing the County Judge to sign an engagement letter with Pattillo, Brown, & Hill LLP for independent audit services for fiscal year 2015. (Nathan Cradduck)

Update:  Grape Creek Road project will be started September 21st, 2015 with a seal coating.  The rest of the project will be postponed until the spring.

19. Consider issues dealing with the following ongoing construction/remodeling projects and  take any action necessary:
A. Judge Edd B. Keyes Building remodel
Update:  New generators were set yesterday.  Ceiling tiles and carpet being installed. May need to do another change order for additional plugs and data outlets.

Moved to approve Change Order #10 in the amount of $8,231.00 for additions and changes as presented.

20.  Future Agenda Items:
 
1.  Several JJC Contracts.
2.  Overtime for road hands for recent fire at Rocking Chair Ranch.

1.  Acknowledge that today's Court Agenda was posted August 28th, 2015 at 3:15 pm.

2.  Dove Season is Open.  

3.  The new Cluster Court Judge will be sworn in this afternoon.

4.  Monday, September 7th, all County Offices will be closed in observance of the Labor Day Holiday.

 
  
22.  Judge Floyd adjourned the meeting at 9:25 am.
